Terms of Service (Website & SMS Program)

1. Agreement to Terms

By accessing swiftgrill.com, placing an order/reservation, joining our SMS/email lists, or otherwise using our services (the “Services”), you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility; Accounts

You must be at least 13 to use the Services and at least 18 to provide consent for marketing messages or place paid orders. You are responsible for keeping account credentials secure.

3. Orders, Reservations & Promotions

Menu items, prices, hours, and availability are subject to change. We may limit quantities. Promotions may have additional terms.

4. Acceptable Use

You agree not to misuse the Services (e.g., reverse engineer, attempt to breach security, infringe IP rights, or use the Services for unlawful purposes).

5. Text Messaging Program (“SMS Program”) {#sms}

• Opt‑in: Enrollment requires express consent via a checkbox on our form or other disclosed method.

• Message Types: marketing or transactional messages related to SwiftGrill (e.g., order alerts, specials, events).

• Frequency & Costs: Message frequency may vary. Message and data rates may apply.

• Opt‑out: Reply STOP to cancel. Reply HELP for help or email su*****@***********ll.com.

• Consent not required: Consent to receive texts is not a condition of purchase.

• Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.

• Eligibility: You represent that you are the subscriber or customary user of the mobile number provided and authorized to opt in.

• Changes: We may change or discontinue the SMS Program at any time, with notice as required.

6. Email Marketing

If you opt in, you agree to receive emails from us. You can unsubscribe at any time via the link in any email.

7. Intellectual Property

All content on the Services is owned by or licensed to SwiftGrill and protected by law. You may not use it without permission.

8. Disclaimers

Services are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including for accuracy, reliability, or fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, SwiftGrill and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability for claims relating to the Services will not exceed the greater of $100 or the amount you paid us in the past 12 months for the Service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold SwiftGrill harmless from claims arising out of your misuse of the Services or violation of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in St. Lucie County, Florida, unless otherwise required by law. You and SwiftGrill waive jury trial to the extent permitted by law.

12. Changes to Terms

We may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use constitutes acceptance.
